OSH legistation - Introduction

Assalamualaikum..

There are 2 main Act governing occupational safety and health in Malaysia which are:
  • Occupational Safety and Health Act 1994 (OSHA 1994) (Act 514)
  • Factories and Machinery Act 1967 (FMA 1967) (Act 139)


OCCUPATIONAL SAFETY AND HEALTH ACT 1994 - Act 514 (OSHA 1994)
Basically, the objective of this act are:
  1. To secure the safety, health, and welfare of persons at work against risks.
  2. To protect persons at a place of work other than persons at work against risks.
  3. To promote an occupational environment for persons at work which adapted to their physiological and psychological needs.
  4. To provide the means of the associated occupational safety and health legislation may be replaced by a system of regulations and approved industry code of practice. These regulations and code of practice operating in combination with the provisions of this Act and designed to maintain or improve the standards of safety and health.



FACTORIES AND MACHINERY ACT 1967 - Act 139 (FMA 1967)
This is an Act to provide for the control of factories with the respect to matters relating to the safety, health and welfare of persons therein, the registration and inspection of machinery and for matters connected therewith.



"These provisions have their own penalty if not compliance"
